Report: The Trump Administration Wants to Define Gender at Birth

The Trump administration is considering defining gender as a biological condition defined by genitalia at birth, the New York Times reported Sunday.

A draft Department of Health and Human Services memo written last spring, which the Times obtained, argues that the government needs to have a uniform definition of gender. “Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth. The sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.”

Such a move would roll back decisions established during the Obama administration that allowed for a less didactic approach sex and gender by the department. According to the Times, 1.4 million Americans who have gone under gender reassignment surgery and identify as a gender other than which they were born.

The Trump administration has previously sought to ban transgender people from serving in the military and challenged transgendered people’s civil rights protections under existing health care law.

According to the Times, the memo was written in an attempt to have the Departments of Education, Justice, and Labor adopt the stricter definition. The agency is expected to present the proposed guidance of to the Justice Department by the end of this year.
